Dear Lawyer,

As for the events that took place during last few days concerning unlawful actions of our Company former employee S.Porutis related to illegal software distribution, also as for your statements concerning possible financial claims of the Microsoft Company, member of BSA, representative of which you are in Lithuania, made on our Company we would like to state the following:

1. JSC Penki Kontinentai, which is software producer and distributor, has always been against any use or distribution of illegal software;

2. JSC Penki Kontinentai has always been doing everything it can to encourage legal software distribution in Lithuania;

3. JSC Penki Kontinentai has taken every measure to clarify all the circumstances of the illegal software distribution event related to S.Porutis' actions. The Company has also done everything possible to make sure no such cases take place in the future, also prevent any mutual relation between similar actions and activity of the JSC Penki Kontinentai Company;

Every employee in our company has to sign a promissory note, which will oblige him not to use and not to distribute unlicensed software, when employed. Svajunas Porutis, former employee of the Company was also acquainted with such rules of JSC Penki Kontinentai. That is why JSC Penki Kontinentai cannot take any responsibility for S.Porutis’ illegal activities, which are not related to activities of the company.

Any announcement made in media concerning our Company are either well-founded or lawful due to the reasons listed above; such statements will only cause damage to reputation of the CJS Penki Kontinentai Company.

With reference to the above said, we would like to ask you to refrain from any fast estimations made concerning responsibility of the CJS Penki Kontinentai Company for the actions taken by the former Company employee S.Porutis before competent institutions make the resolution concerning the action, which was brought against him. We would also like to ask you to not make any relation between our Company and unlawful actions taken by S.Porutis.

As for the questions concerning possible financial claims of the Microsoft Company, the BSA Alliance member, made on the CJS Penki Kontinentai Company we would like to ask for the following from you. As we seek to clarify all legal positions concerning criminal actions of S.Porutis related to illegal software distribution, also prevent any mutual misunderstanding we would like to ask you to please contact our lawyers Algis Molevicius or/and Vladimiras Buslovicius (Lawyer Office Causa Privata Advokatai, Seimyniskiu Street 16, Vilnius, Phone/Fax # 73 41 78, 73 41 76) as soon as possible. The above lawyers are empowered to represent interests of our Company concerning the matter.
